Welcome to CBC Pathways (cbcpathways.org), an AI-driven platform providing career guidance for Kenyan CBC students through aptitude tests, personalized pathways (e.g., STEM, Social Sciences, Arts & Sports), and support for parents, teachers, and government officials. These Terms of Service ("Terms") govern your use of our website, application, and related services ("Service").

By accessing or using our Service, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use our Service. We operate under the laws of Kenya, and these Terms are compliant with the Kenya Data Protection Act 2019 and Consumer Protection Act 2012.

Acceptance of Terms

You must be at least 13 years old to use our Service. Users under 16 require parental consent, as outlined in our Children’s Use section. By using our Service, you confirm that you have the legal capacity to enter into this agreement or have obtained necessary consent.

Our Services

CBC Pathways offers:

• Aptitude Tests: Assessments to identify career interests and skills.
• Career Pathways: Personalized recommendations for fields like STEM, Social Sciences, and Arts & Sports.
• Chatbot Support: AI-driven advice via Dialogflow for career queries.
• Avatar Features: Interactive avatars generated via D-ID (optional).
• Stakeholder Insights: Anonymized, aggregated reports for government officials, principals, and teachers to support educational planning.
• Premium Features: Paid services (e.g., advanced analytics) via Instasend payments.

We use Firebase for authentication and data storage, Google Cloud for hosting and AI processing, and Instasend for secure payments.

User Obligations

As a user, you agree to:

• Provide accurate and complete information when creating an account or taking tests.
• Keep your login credentials secure and not share them with others.
• Use the Service for personal, non-commercial purposes only.
• Comply with all applicable laws, including Kenya’s Data Protection Act.
• Respect the privacy and rights of other users.

Payments and Refunds

Premium features are available via Instasend. By making a payment, you agree to:

• Provide valid payment details and authorize charges.
• Pay applicable taxes as required by Kenyan law.
• Contact us within 7 days for refund requests, subject to our discretion and Instasend’s policies.

Payments are processed securely, complying with PCI-DSS standards. Disputes can be raised via info@cbcpathways.org or Instasend’s support.

Data Sharing

We share only anonymized, aggregated data (e.g., career trend statistics) with:

• Government Officials: To inform educational policies.
• Principals and Teachers: To enhance curriculum and student support.
• Other Stakeholders: For research, without personal identifiers.

Personal data is shared only with:

• Service Providers: D-ID, Firebase, Dialogflow, Google Cloud, and Instasend, under strict agreements.
• Legal Authorities: If required by law.

Intellectual Property

All content on our Service (e.g., tests, AI models, designs) is owned by CBC Pathways or our licensors. You may not copy, modify, or distribute our content without permission. User-generated content (e.g., test responses, avatar media) grants us a non-exclusive license to use for providing and improving the Service.

Prohibited Activities

You may not:

• Use the Service for illegal purposes or to harm others.
• Attempt to hack, reverse-engineer, or disrupt our systems.
• Submit false or misleading information.
• Use automated tools (e.g., bots) to scrape data.
• Share sensitive data (e.g., test results) without authorization.

Violations may lead to account suspension or legal action.

Termination

We may suspend or terminate your account if you violate these Terms, with notice where feasible. You may delete your account via settings or by contacting us. Upon termination, your access to the Service ends, but certain data may be retained per our Privacy Policy.

Limitation of Liability

To the extent permitted by Kenyan law, CBC Pathways is not liable for:

• Indirect or consequential damages (e.g., lost opportunities).
• Inaccuracies in career recommendations or test results.
• Service interruptions due to technical issues.

Our total liability is limited to the amount you paid us in the last 6 months.

Dispute Resolution

Disputes will be resolved through arbitration in Nairobi, Kenya, under the Arbitration Act 1995. You agree to attempt informal resolution by contacting us first. Kenyan law governs these Terms, excluding conflict of law rules.

Children’s Use

Users under 16 require parental consent. Parents can manage their child’s account via info@cbcpathways.org. We comply with COPPA and Kenya’s Data Protection Act for minors.

Changes to Terms

We may update these Terms, notifying you via email or our website 7 days before changes take effect. Continued use after updates constitutes acceptance.
